The LSCU, along with Rep. Ron DeSantis (R-FL), a member of the House Judiciary Committee, have been working to prevent an onslaught of demand letters credit unions could receive stemming from a pending regulation on website compliance with the Americans with Disabilities Act. While we have not seen an influx of such letters in Alabama and Florida, several other states, such as California, have seen a rise in these types of demand letters. The regulation was categorized as inactive by the Department of Justice and has led to numerous demand letters to credit unions.
DeSantis and colleague Rep. Eric Swalwell (D-CA) began circulating a letter across the House of Representatives, which calls on the attorney general to finalize and issue this regulation. The regulation will provide uniform guidelines for compliance which will then allow credit unions recourse when presented with a demand letter. The letter will be circulated for signature for the next two weeks, hopefully gaining mass support among members of the House of Representatives.
