Alabama judge dismisses ADA case against credit union

Two lawsuits filed against credit unions in Alabama and Ohio whose websites allegedly violated the Americans with Disabilities Act were both dismissed this week by District Court judges in each state. These cases follow similar dismissals by District Courts in Virginia. Additionally, the LSCU & Affiliates had entered Amicus briefs in similar cases in Alabama against Naheola Credit Union and The Infirmary Federal Credit Union. Both those cases resulted in a voluntary dismissal by the plaintiff.

Each judge ruled that the plaintiffs had no basis to sue the credit unions which included Decatur, AL-based Family Security Credit Union and Dover, OH-based DoverPhila Federal Credit Union because the plaintiffs were not eligible for membership. The issue of the plaintiffs’ intent was also a consideration for both courts. Read more at Credit Union Times.
